Derogation Status - Anyone know what it is ??

Following on from my post about taking the car before September or waiting for the 69 plate on 1st Sept:

I had an very interesting conversation with my dealer today.

He says that my car has to be registered before the 16th August based on the information the dealer supplied below..

So, waiting for the 69 plate is not an option if the car was built in June/July like mine !!

Doesn't make much sense, anyone know what it is all about ?

Interesting I think it is something to do with WTLP rules and phase in.
Currently considering options.

It looks like some sort of system to make sure older built cars are sold first to stop an earlier built car being overlooked for a newer one. So they dont have them sitting around. All to do with quotas vs stock levels i guess. Would look odd on the system if a cars not registered for a period but sold.

However as your car is already sold and you want it, just holding it for a bit is a different case. It looks like an internal structure they work to.

Ask the dealer to show you what category your car is in, I believe that all T Cross are WLTP compliant.

Hi Greycross et al!

This is a massive issue with me at the moment that has resulted in me cancelling my order for a T-Cross and probably parting company with Volkswagen after being a customer for almost 40 years.

To cut a long story short, I ordered a T-Cross SEL (with a couple of factory fitted options) on 10 April 2019 in good time for my requested delivery date of 1 September 2019.

The vehicle was a week 23 build and all went well until it arrived in the UK when, like you, I received a telephone call from the dealer stating that the car must be registered by 16 August due to non-compliance with the forthcoming RDE (Real-world Driving Emissions) regulations.

I then read the AA web-page (which can be found here):

As a result, I entered into an e-mail conversation with Volkswagen Customer Services (VWCS), quoting from the AA's explanation that

"RDE step 1 – applies to new type approvals from 1 September 2017 and to all new registrations from 1 September 2019."

I felt that, as the official debut of the T-Cross was at the Paris Motor Show in October 2018, the T-Cross range's type approval would have been granted after 1 September 2017 and that my car would therefore automatically be compliant with Step 1.

Unfortunately, after several emails and telephone calls, I could not obtain the definitive answer I asked for and was instead told that VWCS "suggested" I register the vehicle by 31 August 2019.

It was at this stage that I cancelled my order.

Looking at the Irish price list, they refer to MY 2020 being compliant and current models not being

I posted this reply in the T-Roc forum after greycross posted there as well.

I am having the same battle with my dealer as we speak over this issue. My car is at stage 5a and is due by the end of July, early August and I have been told that mine has to be registered by the 16th August. I am away on holiday for two weeks in August and so I had agreed with the dealer a September pick up. My order form also states end of September as well. I have been given a potential £500 towards the cost of the car, cancel the order and receive my deposit in full, cancel and re-order. I am in negotiations over the part exchange price of my car at the moment to soften the deal.

Someone in the car industry perhaps can comment on this but if I cancel the order - the dealer has a car which he needs to sell before the 16th of August. Now he could get lucky and sell it but if he has to pre-register it and then sell it after would this not reduce the sale price?

If I cancel and re-order I go back to waiting for 3/4 months and the alloys are no longer available and I am not sure the 1.6 diesel engine is available as this is not on the car build as an option..

It is a weird complicated thing isn't it !!

I had a phone message left only last Monday saying that Sept 1st was fine, but they are now saying that this new information which only became apparent yesterday has changed everything.

I have been trying to negotiate with the dealer but they say "no can do, has to be registered by August 16th"..
I have tried really hard, played them the telephone message, shown them the order, but they say they can't budge.

I guess my next move will be to try and get something from them (discount, extras etc) in lieu of them bringing the delivery forward.

My concern is the discussion which is bound to happen at the end of the PCP in 3 years time, when they will almost certainly say a August 2019 car is worth less than a Sept 2009 on the new 69 plate !!

VW have really lost the plot hen it comes to delivery of their cars, and their customer service is truly awful.

If I was you ask for cash back and collect now. Threaten to cancel as they would have to sell or pre reg by 16/8.
Currently considering options.

The guaranteed future value is based on the term / mileage so shouldn't impact the trade in if at all fir the sake of two weeks.. Mileage and condition seem to be the factors .

Ask them what the guaranteed future value will be Registered in each month? Bet the difference is nothing.

Public value the newer plates more than the dealers, in 3yrs whichever month its registered in ,its still a 3yr old car to them.
